       Attività di ricerca

La ricerca si è sviluppata essenzialmente lungo due direttrici.  

La prima, nell’ambito più ampio dello studio e dell’approfondimento del pensiero del giurista Santi Romano, massimo esponente della teoria istituzionalista, ha teso verificare  se la ripresa di una prospettiva istituzionalista non possa costituire la chiave di volta per superare l’impasse nella quale sembra essersi arrestata la tradizionale e dominante prospettiva formal-normativa nella lettura  e nella soluzione delle tensioni cui il diritto è sottoposto nella realtà contemporanea (si vedano  in tal senso le teorie neoistituzionaliste, che si propongono nel panorama giusfilosofico contemporaneo, in particolare quella di Neil Mc Cormick quella di  Ota Weinberger).

In questo filone si è  inserita la riflessione elaborata nell’ambito della propria collaborazione alla cattedra di Etica sportiva presso il Corso di Laurea in Scienze del turismo e dello sport – Curriculum Governance dello sport (già Scienze giuridiche, economiche e manageriali dello sport). Premesso che il mondo dello sport è già stato oggetto di interesse da parte degli studiosi del diritto, quale forma della coesistenzialità in cui si esperimenta una sorta di auto-organizzazione delle relazioni, che dà luogo ad una struttura per molti versi assimilabile alle forme di organizzazione politico-giuridiche (fra i tanti si citano gli studi di W. Cesarini Sforza e M.S. Giannini), gli interessi di studio si sono concentrati nell’analisi dei circoli relazionali riconoscibili nella pratica sportiva, nonché delle alterazioni che si possono produrre a causa dell’irrompere della pratica dopante: tutto ciò è stato oggetto del contributo Doping: una questione bioetica?, pubblicato nel collettaneo Le luci dello sport. Una visione prismatica del fenomeno (2011), la cui edizione è stata curata dalla sottoscritta. Una riflessione che si innesta nell’ambito più vasto di una ri-considerazione dei fondamenti della pratica sportiva,  che ha avuto una parziale formalizzazione nella  relazione Fair Play: una dimensione fondamentale dello sport?,  tenuta al 38th  Annual Meeting of the International Association for the Philosophy of Sport –Roma 15-19 settembre 2010, come nella relazione Doping e frode sportiva, tenuta nel corso dell’incontro di studio su Sport, diritto e società (17 settembre 2011).

La seconda linea di ricerca ha portato alla considerazione delle problematiche   che si pongono ai nostri giorni dallo svilupparsi delle possibilità di intervento in campo   biotecnologico, soprattutto per quanto concerne le provocazioni che tali sviluppi pongono alla giuridicità contemporanea: in tal senso possono essere interpretati la relazione Chi  decide cosa, tenuta  al convegno Diagnosi e terapia dei disturbi della differenziazione sessuale. Attualità e prospettive, Chieti 4 giugno 2011, ulteriormente sviluppata ed approfondita nell’intervento Minori affetti da DSD: chi decide cosa? (XXIX Congresso Nazionale SIFD   La filosofia del diritto fra storia delle idee e nuove tecnologie, Bologna-Ravenna 18-20 settembre  2014) e l'intervento così Ai confini della vita: questioni di indefinitezza (XXX Congresso SIFD Limiti del diritto, Lecce 15-17 settembre 2016), così  come la redazione della voce Questione animale e Diritto promozionale e premiale, pubblicata  nel  Trattato di Biodiritto, t. V – La questione animale.

In questo filone è possibile inserire la riflessione maturata nel corso della propria esperienza didattica del Corso di Bioetica, tenuto a partire dall’a.a. 2003-2004, presso il  Corso di Laurea in Biotecnologie, la cui particolare natura (si tratta di un corso interfacoltà Medicina Veterinaria ed Agraria) ha determinato un approfondimento delle questioni che si pongono nell’ambito della ricerca scientifica e delle sue applicazioni, cogliendo soprattutto le sollecitazioni ad una rimodulazione, se non ad una rifondazione, delle categorie che sorreggono la razionalità scientifica.  

Entrambi i filoni di ricerca, all’apparenza affatto distanti l’uno dall’altro, sono accomunati da un taglio dell’approfondimento che si caratterizza per un approccio  di teoria giuridica che ha trovato parziali formalizzazioni nella redazione di alcune voci (Abuso, Banca del seme – parte giuridica – diritti positivi odierni, Diagnosi prenatale e postnatale – parte giuridica – diritti positivi odierni, Tecniche di fecondazione artificiale – parte giuridica – diritti positivi odierni), per l’Enciclopedia di Bioetica e Scienza giuridica,   quanto le  relazioni presentate annualmente ai World IASL Congresses (Athens 2008, Warsaw 2009, Seoul 2010, Moscow 2011, Beijing 2012, Bali 2013, Athens 2014, Marrakech, 2015, Sochi 2016, Roma 2017, Athens 2018)  ed alle  SRLA annual Conferences (New Orleans 2016; Las Vegas 2017; San Antonio 2018; Philadelphia 2019), delle quali le prime hanno trovato formalizzazione sistematizzata nella monografia Doping: Legal Theory (2011)

Research interests

The research interests have developed along two guiding ways that characterized the entire reflection.
The first one  is part of the deepening of Santi Romano’s institutionalist theory. It aims to verify if the resumption of an institutional perspective could be the key to overcome the impasse in which the traditional formal-normative perspective  seems to fall, because of its inability to resolve tensions to which Law is subject in the contemporary age (in this sense see the contemporary neo-institutionalist legal theories, as that one of Neil Mc Cormick and that one of Ota Wienberger). .

Inside this, it is inserted the reflection developed in the context of its cooperation to the course of Sport Ethics at the Degree Course in Juridical, Economics and Managerial Science of Sport. It is too well-known  that the world of sport has interested legal scholars, as a form of co-existentiality in which individual experiment a kind of self-organization of relations, giving rise to a structure, which can be assimilated to a legal  organization. (Among many studies, see those ones of Widar Cesarini Sforza and   Massimo Severo Giannini). On these premises, research interests   focused on the analysis of relationships that are recognizable in sport and the changes resulting from diffusion of doping: this has been the subject of a first essay, Bioethics and doping, published in the book Le luci dello sport. Una visione prismatica del fenomeno (2011). This  consideration is part of  the broader deepening on the grounds of sport, partially developed in the speech Fair Play: a fundamental dimension of sport?, held at the 38th Annual Meeting of the International Association for the Philosophy of Sport (Rome,  15-19   September 2010), such as the speech  Doping and sporting fraud, held during the Seminar  Sport, Law And Society (17 September 2011).

The second line of research  led to the consideration of issues, arising  today because of the development of possibilities of manipulation in the biotechnological field, especially  with regard to  the challenges arising for Law in the contemporary age. In this sense see the speech Who decides what?, held at the Congress Diagnosis and Treatment of Disorders Of Sexual Differentiation. News and perspectives (Chieti June 4, 2011), further developed and deepened in the speeches Minors with DSD: who decides what? (XXIX SIFD National Congress, Bologna Ravenna 18-20 September 2014) and At the edge of life: questions of indefiniteness  (XXX SIFD National Congress, Lecce 15-17 September 2016), as well as the essay Animal Issue  and Promotional-Awarding Law,  in the Bio-Law Treatise, V, The Animal Issue, 2012.

Within this line, there is the reflection gained during of their teaching experience of the course of Bioethics, held since the academic year 2003-2004, at the Degree Course in Biotechnology.  The course led to the deepening of the issues arising within  scientific research and its applications, in particular stressing the need of a re-modulation, if not a new foundation,  of the categories that underpin   scientific rationality.


Both lines of research, apparently very far from each other, are linked by a legal theory approach, partially developed in some encyclopedic items (Abuse, Sperm Bank, Prenatal and Postnatal Diagnosis) of the Bioethics and Legal Science Encyclopedia, as well as the speeches held  yearly at the World IASL Congresses (Athens 2008, Warsaw 2009, Seoul 2010, Moscow 2011, Beijing 2012, Bali 2013, Athens 2014, Marrakech, 2015, Sochi 2016, Roma 2017, Athens 2018),as well as at SRLA Conferences (New Orleans 2016; Las Vegas 2017; San Antonio 2018; Philadelphia 2019). The formers  have been organized  in a systematic manner in the book Doping: a Legal Theory (2011)
